In February, property owners receive their annual assessment notice detailing the taxable and/or assessed value on which the tax amount they will owe for the year is based. Sometimes, the assessed amounts are fair and accurate. Other times, they are not.

Filing an Appeal Correctly Is a Necessity

If you’re concerned that your property hasn’t been correctly assessed, you need to take immediate action.

For residential properties, the deadline to file with the Michigan Tax Tribunal is July 31st. For commercial and developmental properties, you should file a petition with the Michigan Tax Tribunal as soon as you receive your assessment notice, but after May 31st. Filing a petition with the Michigan Tax Tribunal is akin to purchasing a ticket to stand in line to get on a bus. However, your time in line could last up to 24 months. While you wait, you have time to negotiate with the city or township to try and settle your appeal prior to the hearing.

Once an appeal is filed, we will meet with the appropriate representatives to begin negotiation. Negotiating a property tax appeal, especially for a property that produces income, can take many months. The length of time typically depends on the goals you’ve set for resolution. If negotiation fails, a pre-hearing will be scheduled. Finally, you will need to attend a property tax appeal hearing. As your legal counsel, I will accompany you to this hearing and throughout every step of the legal process, so feel prepared for what comes next.
